These Terms and Conditions (“Terms”) govern your access to and use of the SMART CEUs Hub website located at www.smartceushub.com (the “Site”) and all related online courses, subscriptions, content, and services (collectively, the “Services”). The Site and Services are owned and operated by SMART CEUs Hub, LLC (“SMART CEUs Hub,” “we,” “us,” or “our”).

By accessing or using the Site or Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you may not access or use the Site or Services.

We reserve the right to update or modify these Terms at any time. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.


1. Eligibility & Account Registration

The Services are intended for individuals who are 18 years of age or older.

To access certain features of the Services, including courses, certificates, and memberships, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify SMART CEUs Hub immediately of any unauthorized use of your account.


2. Children’s Privacy (COPPA Compliance)

In accordance with the Children’s Online Privacy Protection Act (COPPA), SMART CEUs Hub does not knowingly collect personal information from individuals under the age of thirteen (13).

If an educational institution utilizes the Services for students under the age of thirteen, the institution represents that it has obtained all required parental consents and authorizations and may provide limited information solely for the purpose of delivering the Services.


3. Services & Educational Disclaimer

SMART CEUs Hub provides online continuing education and professional development courses. While certain courses may be approved or accepted by professional boards, certifying bodies, or licensing authorities, SMART CEUs Hub does not guarantee acceptance of any course or certificate by any specific board, employer, or regulatory authority.

It is the user’s responsibility to verify continuing education requirements with their applicable certification or licensing body.


4. Intellectual Property

All content available on the Site and through the Services—including but not limited to text, videos, graphics, logos, course materials, software, trademarks, service marks, and design elements—is owned by or licensed to SMART CEUs Hub and is protected by U.S. and international intellectual property laws.

Except as expressly permitted in writing, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our prior written consent.

All trademarks and service marks displayed on the Site are the property of SMART CEUs Hub or their respective owners.


5. User-Generated Content

You retain ownership of any content you submit, post, or upload to the Services (“User Content”). By submitting User Content, you grant SMART CEUs Hub a non-exclusive, worldwide, perpetual, royalty-free, sublicensable license to use, reproduce, modify, distribute, display, perform, and create derivative works from such User Content in connection with operating, improving, and promoting the Services.

SMART CEUs Hub reserves the right, but not the obligation, to remove or restrict User Content that violates these Terms, our Community Guidelines, or applicable law.


6. Acceptable Use & User Conduct

While using the Site or Services, you agree not to:

  • Violate any applicable laws or regulations

  • Infringe upon the intellectual property or legal rights of others

  • Attempt to gain unauthorized access to systems, accounts, or data

  • Circumvent security features or access restrictions

  • Impersonate any person or entity

  • Interfere with or disrupt the operation of the Site or Services

  • Use the Services for unlawful, abusive, or deceptive purposes

Violation of this section may result in immediate suspension or termination of your account.


7. External Websites

The Site may contain links to third-party websites. These links are provided for convenience only. SMART CEUs Hub does not control and is not responsible for the content, accuracy, or practices of third-party websites.

Access to external websites is at your own risk.


8. Unlimited CEUs Membership Terms

Subscription Access

The Unlimited CEUs Membership provides access to SMART CEUs Hub’s continuing education course library and community features only while the subscription remains active.

Certificates of Completion

Certificates of completion may be downloaded during an active subscription. Certificates remain stored within your account after cancellation; however, it is the user’s responsibility to download and retain copies for personal records or submission to credentialing bodies.

Automatic Renewal

Unless canceled prior to renewal, the Unlimited CEUs Membership automatically renews on an annual basis using the payment method on file.

An automated reminder email will be sent approximately seven (7) days prior to renewal.

Cancellation

You may cancel your subscription by contacting SMART CEUs Hub prior to the renewal date. Cancellations take effect at the end of the current billing period.

Refund Policy

  • A seven (7) day full refund window applies from the date of a renewal charge

  • After the seven (7) day period, no refunds or prorated refunds will be issued

  • All billing disputes are governed by these Terms


9. Termination

SMART CEUs Hub reserves the right, in its sole discretion, to suspend or terminate your access to the Site or Services at any time, with or without notice, for violation of these Terms or for any lawful reason.

Termination does not limit any rights or remedies available to SMART CEUs Hub.


10. Disclaimer of Warranties

The Site and Services are provided “as is” and “as available”, without warranties of any kind, express or implied.

SMART CEUs Hub disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.


11. Limitation of Liability

To the maximum extent permitted by law, SMART CEUs Hub shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or Services.

SMART CEUs Hub’s total liability shall not exceed the amount paid by you to SMART CEUs Hub in the twelve (12) months preceding the event giving rise to the claim.


12. Indemnification

You agree to defend, indemnify, and hold harmless SMART CEUs Hub, its officers, directors, employees, contractors, affiliates, successors, and assigns from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site or Services or your violation of these Terms.


13. Copyright Infringement (DMCA Notice)

SMART CEUs Hub respects the intellectual property rights of others. If you believe that your copyrighted work has been infringed, please submit a written notice including all information required under the Digital Millennium Copyright Act (DMCA) to:

SMART CEUs Hub, LLC’s registered agent is maintained through LegalZoom in the State of Nevada.


14. Privacy & Data Retention

Personal information is handled in accordance with our Privacy Policy.

Order and account information is retained unless and until you request deletion, subject to legal, regulatory, and legitimate business obligations.

European residents may exercise rights under the General Data Protection Regulation (GDPR) by contacting us.


15. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

You agree that any legal action arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Smith County, Texas.

YOU WAIVE ANY RIGHT TO A JURY TRIAL.


16. Miscellaneous

These Terms constitute the entire agreement between you and SMART CEUs Hub regarding the Site and Services and supersede all prior agreements or understandings.

If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.

No waiver of any provision shall be effective unless in writing and signed by SMART CEUs Hub.
